Welcome to House of W! House of W is operated by House of W Trust LLC. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to House of W and House of W Trust LLC.
House of W operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you access or use the Services.
Please read these Terms of Service carefully, as they contain important information regarding your legal rights and obligations, including warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not access or use our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or place of residence, or that you are the age of majority and have given your consent to allow any of your minor dependents to use the Services on devices you own or manage.
To access or use certain features of the Services, including browsing our online store, creating an account, or purchasing our products, you may be asked to provide certain information, such as your name, email address, billing information, payment information, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide such information.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to promptly notify us if you become aware of any unauthorized use of your account or other security breach.
You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We make every effort to accurately represent and describe the products offered by House of W. However, colors and product appearance may vary slightly from what is displayed on your screen due to differences in devices, displays, lighting, materials, and other factors.
Many House of W products are made to order and produced using 3D-printing and other manufacturing processes. Because of the nature of these processes, minor variations in color, texture, layer lines, surface finish, or other cosmetic characteristics may occur between products. These minor variations are normal and do not necessarily constitute a defect.
For personalized or custom products, customers are responsible for reviewing and confirming all personalization details, including names, initials, colors, sizing, and other selections, before submitting an order. Personalized products may differ slightly in appearance depending on the characters, colors, or customization selected.
We make every reasonable effort to ensure that product descriptions, photographs, dimensions, and other information provided on our store are accurate. However, we do not guarantee that a product's appearance will be identical to photographs or digital representations displayed on our store.
Product descriptions, designs, colors, materials, pricing, and availability are subject to change without notice. We reserve the right to modify or discontinue any product and to limit the quantities of products available to any person, geographic region, or jurisdiction, as permitted by applicable law.
SECTION 3 - ORDERS
When you place an order with House of W, you are making an offer to purchase the products selected in your order. We reserve the right to accept, decline, limit, or cancel an order for any lawful reason, including product availability, errors in product or pricing information, suspected fraud, or other circumstances that may prevent us from fulfilling the order.
Payment must be successfully authorized and processed before an order can be fulfilled. If we decline, modify, or cancel an order after payment has been processed, we will issue any applicable refund to the original payment method and attempt to notify you using the contact information provided with your order.
Please review your order carefully before submitting it, particularly any personalization, initials, names, colors, sizes, quantities, or other custom selections. Because many House of W products are made to order, we cannot guarantee that an order can be changed or canceled once production has begun.
Personalized and custom-made products are final sale once production has begun, except when an item arrives damaged, defective, or was made incorrectly by House of W. Returns, exchanges, cancellations, and refunds are otherwise governed by our Return and Refund Policy.
We reserve the right to limit or refuse orders that reasonably appear to be placed for unauthorized resale, fraudulent purposes, or other misuse of our Services.
SECTION 4 - PRICES AND BILLING
All prices displayed by House of W are listed in U.S. dollars unless otherwise stated. Prices, discounts, promotions, shipping rates, and product availability are subject to change without notice. The price charged for a product will be the price displayed at the time your order is placed, subject to any applicable discounts or promotions.
Unless otherwise stated, product prices do not include applicable taxes, shipping charges, customs duties, import fees, or other charges that may apply to your order. Any applicable charges collected by House of W will be displayed during checkout before you complete your purchase.
From time to time, House of W may offer promotional pricing, discount codes, free shipping offers, or other promotions. Promotions may be subject to additional terms, eligibility requirements, expiration dates, exclusions, or limitations and may be modified or discontinued as permitted by law. Unless otherwise stated, promotions and discount codes may not be combined.
You agree to provide current, complete, and accurate billing, payment, shipping, and account information for all purchases made through our store. You are responsible for ensuring that the information provided with your order is accurate so that we can process and fulfill your purchase.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize House of W and its payment processors to charge the total amount shown at checkout, including applicable taxes, shipping charges, and other disclosed fees.
If we discover an error in the price or other material information associated with an order, we reserve the right to contact you to correct the order or cancel and refund the affected purchase, as permitted by applicable law.
SECTION 5 - SHIPPING AND DELIVERY
House of W ships orders to the shipping address provided by the customer at checkout. Please review your shipping information carefully before submitting your order. Customers are responsible for providing a complete and accurate delivery address.
Because many House of W products are made to order or personalized, processing and production time may be required before an order is shipped. Processing times are separate from the estimated transit times shown at checkout.
Once an order has shipped, you will receive shipping confirmation and tracking information when available.
Estimated shipping times are provided for convenience and are not guaranteed. Standard shipping is generally estimated at 3–5 business days in transit, and Express shipping is generally estimated at 1–2 business days in transit after the order has been processed and transferred to the carrier. Actual delivery times may vary.
House of W is not responsible for carrier delays or delays caused by weather, service disruptions, incorrect or incomplete shipping information provided by the customer, or other circumstances outside our reasonable control.
If your package appears to be lost, arrives damaged, or you experience another delivery issue, please contact us at houseofwtrust@gmail.com with your order number so we can review the situation and assist you.
Applicable shipping charges and available shipping methods will be displayed at checkout. Orders that meet the current free-shipping threshold will automatically receive free Standard shipping when eligible. Promotional shipping offers, including free shipping, may be subject to additional terms or exclusions.
SECTION 6 - INTELLECTUAL PROPERTY
The House of W website and Services, including our branding, logos, product designs, photographs, videos, graphics, text, product descriptions, website content, and other original materials, are owned by or licensed to House of W and/or House of W Trust LLC and are protected by applicable copyright, trademark, and other intellectual property laws.
Unless otherwise expressly permitted by us in writing, the content and materials available through our Services are provided for your personal, non-commercial use only. You may not reproduce, copy, distribute, modify, republish, display, sell, license, create derivative works from, or otherwise exploit our content or intellectual property for commercial purposes without our prior written permission.
Purchasing a House of W product does not transfer ownership of any intellectual property rights associated with the product, including rights in the underlying product design, artwork, photographs, branding, or other proprietary materials.
For personalized or custom products, the addition of customer-provided names, initials, text, colors, or other personalization does not transfer ownership of House of W's underlying product designs or other intellectual property.
If you provide House of W with names, initials, text, logos, artwork, images, or other materials for use in a personalized or custom order, you represent that you have the necessary rights or permission for us to use those materials for the purpose of creating and fulfilling your order. You remain responsible for the materials you provide.
The House of W name, logo, branding, product names, designs, and other brand identifiers may not be used in a manner that suggests affiliation with, sponsorship by, or endorsement from House of W without our prior written permission.
Certain names, logos, trademarks, designs, or other materials appearing through the Services may belong to Shopify or other third parties. All such intellectual property remains the property of its respective owner.
Except as expressly permitted in these Terms, nothing contained in the Services grants you any license or right to use intellectual property belonging to House of W, House of W Trust LLC, Shopify, or any third party. All rights not expressly granted are reserved.
SECTION 7 - OPTIONAL TOOLS
From time to time, House of W may provide access to tools, features, applications, integrations, or services offered by third parties as part of our Services. These may include payment, personalization, shipping, tracking, communication, or other features that help us operate our store and serve our customers.
Certain third-party tools and services are operated independently from House of W. We do not control and are not responsible for the operation, availability, content, policies, or practices of third-party providers, except to the extent required by applicable law.
Your use of optional third-party tools or services may be subject to additional terms, conditions, and privacy policies established by the applicable third-party provider. We encourage you to review those terms and policies when appropriate.
To the fullest extent permitted by applicable law, House of W is not responsible for losses or damages arising solely from your use of an independently operated third-party tool or service.
We may introduce, modify, or discontinue features, tools, integrations, or other resources made available through the Services from time to time. Any new features or services provided directly by House of W will also be subject to these Terms of Service unless otherwise stated.

Our Services may contain links to, integrations with, or content provided by websites, platforms, or services operated by third parties. These third-party websites and services are independently operated and are not controlled by House of W.
House of W is not responsible for the content, accuracy, availability, security, privacy practices, policies, products, or services provided by third-party websites or services. The inclusion of a link or integration does not necessarily imply that House of W endorses or is affiliated with the third party.
If you choose to access a third-party website or service through a link provided on our website, your use of that website or service will be subject to the third party's own terms, conditions, and privacy policies. We encourage you to review those policies before providing personal information or completing a transaction.
To the fullest extent permitted by applicable law, House of W is not responsible for losses or damages arising from your independent use of, or transactions with, third-party websites, products, services, or content.
Questions, concerns, complaints, or claims regarding products or services purchased directly from a third party should be directed to that third party. This does not affect your rights regarding products purchased directly from House of W.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
House of W is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with House of W. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and House of W, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with House of W.
SECTION 10 - PRIVACY POLICY
Personal information collected through our Services is handled in accordance with our Privacy Policy. Our Privacy Policy explains how House of W collects, uses, discloses, and protects personal information when you visit our website, place an order, communicate with us, or otherwise use our Services.
Our store is hosted and powered by Shopify. As part of providing and improving the Services, Shopify may collect and process certain personal information relating to your access to and use of our store. Certain personal information may also be processed by Shopify and other service providers that help us operate our store, process payments, fulfill orders, provide shipping services, prevent fraud, communicate with customers, and provide other functionality associated with the Services.

If you submit, upload, post, email, tag us in, or otherwise provide House of W with reviews, photographs, videos, comments, suggestions, ideas, or other content relating to our products or Services (collectively, “Feedback”), you represent that you have the right to provide that Feedback and that doing so does not violate the rights of any third party.
By voluntarily providing Feedback to House of W, you grant House of W and House of W Trust LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, share, and distribute that Feedback for purposes related to operating, improving, and promoting our business and Services, including on our website, social media accounts, and other marketing materials, to the extent permitted by applicable law.
Unless otherwise agreed in writing, we are not obligated to keep Feedback confidential, provide compensation for Feedback, or respond to Feedback.
You agree that any Feedback you provide will be truthful and will not contain unlawful, defamatory, abusive, obscene, fraudulent, or misleading content; infringe upon another person's copyright, trademark, privacy, publicity, or other rights; or contain viruses, malware, or other harmful code.
If you received compensation, a free product, discount, or other incentive in connection with providing a review, endorsement, or other Feedback, you agree to disclose that relationship as required by applicable law.
We reserve the right, but are not obligated, to monitor, edit, decline to publish, or remove Feedback from areas of our Services that we control when we reasonably believe the Feedback violates these Terms, applicable law, or the rights of another person.

We make reasonable efforts to ensure that the information provided through the House of W website and Services is accurate and current. However, occasionally our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, dimensions, colors, pricing, promotions, availability, shipping charges, processing times, transit times, or other information.
We reserve the right to correct errors, inaccuracies, or omissions and to update or change information at any time without prior notice.
If a material error affects an order you have already placed, such as an incorrect price, product description, or availability issue, we may contact you to provide corrected information, offer an appropriate alternative when available, or cancel the affected portion of the order and issue a refund to the original payment method.
Nothing in this section limits any rights or remedies available to customers under applicable law.
SECTION 13 - PROHIBITED USES
You may access and use the Services only for lawful purposes and in accordance with these Terms of Service.
You may not access or use the Services, directly or indirectly, to:

(d) harass, threaten, abuse, defame, intimidate, or otherwise harm any person;
(e) submit, transmit, or distribute false, fraudulent, misleading, defamatory, obscene, or otherwise unlawful content or information;
(f) impersonate another person or entity or misrepresent your identity or affiliation with any person or organization;
(g) transmit unsolicited advertising, promotional materials, spam, phishing messages, chain letters, or other unauthorized solicitations;
(h) upload, transmit, distribute, or introduce viruses, malware, malicious code, or other technology intended to damage, disrupt, interfere with, or compromise the Services or another user's device or information;
(i) collect, scrape, harvest, or obtain personal information about other users without authorization;
(j) reproduce, copy, duplicate, sell, resell, commercially exploit, or otherwise misuse any portion of the Services or House of W content except as expressly permitted by these Terms or with our prior written permission;
(k) use bots, automated systems, scraping tools, artificial intelligence systems, or similar technologies in a manner that interferes with the operation of the Services, circumvents access restrictions, extracts House of W content for unauthorized commercial purposes, or violates applicable law or these Terms;
(l) attempt to gain unauthorized access to the Services, customer accounts, computer systems, networks, or data associated with the Services; or
(m) bypass, disable, interfere with, or circumvent security, access-control, authentication, or other protective measures associated with the Services.
We reserve the right to restrict, suspend, or terminate access to the Services when we reasonably determine that a user has violated these Terms, misused the Services, or engaged in conduct that threatens the security, integrity, or operation of the Services, subject to applicable law.
SECTION 14 - AGENTS
14.1 This section (“Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in Section 14.4 below. In addition, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from accessing, using, or interacting with any Service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, or interacts with the Services.
14.4 Agents must:
(i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: “Agent/[agent name]”;
(ii) not conceal or obfuscate that any access, use, or interaction is from an Agent, including by mimicking human behavior or interaction patterns or by completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from human use;
(iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and
(iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

These Terms of Service remain in effect unless and until terminated by either you or House of W.
We reserve the right to restrict, suspend, or terminate your access to all or any part of the Services if we reasonably determine that you have violated these Terms of Service, engaged in fraudulent, unlawful, abusive, or harmful activity, interfered with the operation or security of the Services, or otherwise misused the Services.
Termination or restriction of access does not affect any rights or obligations that arose before the effective date of termination. You remain responsible for any amounts lawfully due for orders or transactions completed before termination, subject to our applicable refund, cancellation, and other policies.
Where appropriate, House of W may also cancel or refund an affected order in connection with the termination or restriction of access.
The following provisions will continue to apply after termination to the extent applicable: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature are intended to survive termination.
SECTION 16 - DISCLAIMER OF WARRANTIES
We make reasonable efforts to provide accurate and helpful information through the House of W website and Services. However, information provided through the Services is made available for general informational purposes, and we do not guarantee that all information will always be complete, current, or error-free.
As described elsewhere in these Terms, product colors, finishes, dimensions, and appearance may vary slightly from photographs or digital representations. Because many House of W products are made to order and may be produced using 3D-printing or other manufacturing processes, minor variations in color, texture, layer lines, surface finish, or other cosmetic characteristics may occur and do not necessarily constitute a defect.
Except for any warranties, remedies, or representations expressly provided by House of W in these Terms, our Return and Refund Policy, or as otherwise required by applicable law, the Services and products offered through the Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, House of W disclaims warranties or conditions that are not expressly provided by us, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that access to our website or Services will always be uninterrupted, timely, secure, or error-free, or that all website errors will be corrected immediately.
Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, House of W, House of W Trust LLC, and our respective owners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of the Services or products purchased through the Services, including lost profits, lost revenue, lost savings, loss of data, or similar losses.
House of W is not responsible for losses or damages resulting from circumstances outside our reasonable control, including carrier delays, service interruptions, third-party services, or inaccurate information provided by a customer.
To the fullest extent permitted by applicable law, Shopify and its affiliates will not be liable for losses, claims, or damages arising from products purchased directly from House of W or transactions between you and House of W, consistent with Section 9 of these Terms.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited, or to restrict any rights or remedies available to you under applicable consumer protection law.
The limitations in this section apply only to the fullest extent permitted by applicable law.
SECTION 18 - INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless House of W, House of W Trust LLC, Shopify, and our respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from and against third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or relating to:
(a) your material breach of these Terms of Service;
(b) your violation of applicable law or the rights of a third party;
(c) your fraudulent, unlawful, or unauthorized use of the Services; or
(d) any names, logos, artwork, photographs, images, text, designs, or other materials you provide to House of W for use in a personalized or custom order, including claims that such materials infringe or violate the intellectual property, privacy, publicity, or other rights of a third party.
We will provide reasonable notice of any claim for which we seek indemnification under this section. A delay in providing notice will not relieve you of your obligations under this section except to the extent that the delay materially prejudices your ability to respond to or defend the claim.
We may participate in or assume control of the defense of an indemnified claim with counsel reasonably selected by us. You agree to reasonably cooperate in the defense of the claim, including by providing relevant information or documents in your possession.
We will not agree to a settlement that imposes a material non-monetary obligation on you without your consent, which will not be unreasonably withheld.
This section applies only to the fullest extent permitted by applicable law and does not require you to indemnify House of W for claims arising from House of W's own unlawful conduct, gross negligence, or willful misconduct.
SECTION 19 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law.
If any portion of the provision cannot be enforced, that portion will be considered severed from these Terms of Service. The remaining provisions will continue in full force and effect and will not be affected by the invalidity or unenforceability of the severed provision.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
If House of W does not exercise or enforce any right or provision of these Terms of Service, that does not constitute a waiver of that right or provision. Any waiver by House of W must be expressly made and will apply only to the specific circumstances for which it is given.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies or terms expressly incorporated into or referenced by these Terms, constitute the entire agreement between you and House of W regarding your use of the Services and purchases made through our store.
These Terms supersede any prior or contemporaneous agreements, communications, representations, or proposals relating to the Services, whether oral or written, except for any separate written agreement expressly entered into between you and House of W.
If any provision of these Terms conflicts with a specific policy or written agreement applicable to a particular transaction, the more specific terms will govern that transaction to the extent of the conflict.

These Terms of Service and any separate agreements through which House of W provides Services to you will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.
To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms of Service or the Services will be brought in a state or federal court located in California, and you and House of W consent to the jurisdiction of such courts.
Nothing in this section limits any rights you may have under applicable consumer protection laws or any law that provides you with the right to bring a claim in another jurisdiction or venue.

House of W reserves the right to update, modify, or replace these Terms of Service from time to time by posting the revised Terms on our website. If we make material changes to these Terms, we will provide notice when required by applicable law.
Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms to the extent permitted by applicable law.
Changes to these Terms will not retroactively alter the terms applicable to a purchase completed before the updated Terms became effective, except where required by applicable law or expressly agreed to by you and House of W.
